Unlike many court processes, the ART generally cannot extend the time limit for migration and protection matters — meaning a single missed day can permanently close your right to merits review. Here's what actually happens, and what options remain.

Why ART Deadlines Are So Strict

For migration and refugee decisions, the ART has no general power to extend time, unlike some of its other review jurisdictions. This is set out under the Migration Act 1958 and Migration Regulations 1994. The deadline runs from the date you're deemed to have been notified of the decision — not necessarily the day you actually read the letter — so postal and email notification rules matter enormously.

Standard ART Appeal Deadlines

Your exact deadline depends entirely on your visa type and decision category:

  • Most onshore visa refusals: around 21 to 28 days from deemed notification
  • Character-related (section 501) cancellations: as little as 9 days from notification
  • Protection visa cancellations while in detention: 14 days from the decision
  • Protection visa cancellations outside detention: 28 days from the decision
  • Decisions made while you're offshore: generally up to a 70-day period

Always check your refusal or cancellation letter — it states the exact deadline that applies to your specific case.

The ART's power to extend time is generally excluded for migration and protection matters as a deliberate policy choice, reinforced by Practice Directions that took effect from 2 March 2026, which have made the Tribunal's procedures more court-like and strict. Remaining Options After a Missed Deadline

Even without merits review, limited pathways may still exist:

  • Judicial review in the Federal Circuit and Family Court, but only if the original decision itself was affected by a jurisdictional error — this must generally be filed within 35 days of the original decision, not the missed ART deadline
  • Ministerial Intervention under section 351 (or section 501J for protection visa character cases), a discretionary last resort with no guaranteed outcome
  • A fresh visa application, where eligible, particularly if your circumstances have changed since the original decision
