Dedicated Support

Most partner visa applicants focus entirely on their own eligibility and forget something critical: the sponsor must qualify too — separately, and just as strictly. Since the sponsorship approval reforms, Home Affairs now assesses the sponsor before the visa itself can be decided. If your sponsor doesn't meet the requirements, the entire application is refused — no matter how genuine the relationship is. Here's exactly what the Department checks in 2026.

Who Can Sponsor a Partner Visa in Australia?

To sponsor a Partner visa (subclasses 820/801 onshore or 309/100 offshore), your partner must be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen, and at least 18 years old. Sponsorship must be formally approved by Home Affairs — it isn't automatic just because you're in a relationship. The applicant lodges the visa application first, then shares the Transaction Reference Number (TRN) with the sponsor, who lodges Form 40SP through ImmiAccount.

Sponsor Eligibility Requirements Checklist

Before approval, Home Affairs checks that the sponsor:

  • Holds valid proof of citizenship, permanent residency, or eligible NZ citizen status
  • Is not currently subject to a sponsorship bar or restriction
  • Has not exceeded the lifetime sponsorship limit (see below)
  • Passes a character assessment, including an AFP National Police Check (Code 33)
  • Has no significant criminal record for relevant offences — including violence, stalking, AVO breaches, or trafficking-related convictions
  • Provides consistent, accurate answers across both the sponsorship and visa applications

The Lifetime Sponsorship Limit: Two Partners, Five Years Apart

Under Regulation 1.20J of the Migration Regulations, a person can generally sponsor a maximum of two partners in their lifetime, and no more than one partner within any five-year period. If you've sponsored before, you'll typically need to wait five years before sponsoring again. Waivers exist for compelling circumstances, but Home Affairs grants them sparingly — this isn't a box you can talk your way around with a strong relationship alone.

Sponsor Character and Police Check Requirements

Character assessment is non-negotiable. A "significant criminal record" generally means a sentence, or combined sentences, totalling 12 months or more. Family violence and sexual offence history trigger close, mandatory review under the family violence provisions strengthened in recent years. Sponsors with any relevant history should get advice before lodging — not after a refusal.

Worried your sponsorship history or character record could be a problem? Talk to Australian Immigration Consultants before you lodge. A pre-lodgement sponsor assessment can catch issues while there's still time to address them.

Common Reasons Sponsorship Gets Refused

  • Exceeding the two-lifetime or five-year sponsorship limit without a valid waiver
  • Undisclosed or inconsistent previous relationship/sponsorship history
  • Incomplete Form 40SP or missing police checks
  • Character concerns not addressed with supporting statements or evidence
  • Sponsor and applicant answers that don't match across both applications

Ongoing Sponsor Obligations After the Visa Is Granted

Sponsorship doesn't end at approval. Once the temporary Partner visa (820/309) is granted, the sponsor generally must remain the sponsor for the full two-year period leading to the permanent stage — sponsors cannot simply be swapped out. Sponsors are also expected to keep Home Affairs updated on any change in circumstances, address, or relationship status during processing.

How Australian Immigration Consultants Helps Sponsors Get It Right

At Australian Immigration Consultants, led by MARA-registered migration agent Fahad Shamim (MARN 2619225), we assess both sides of the application — applicant and sponsor — before anything is lodged. That means checking sponsorship history against the 2-in-5 rule, reviewing character risk factors early, and making sure Form 40SP and the visa application tell one consistent, decision-ready story. Getting the sponsor side right the first time avoids the fast-track refusals now common under 2026 processing rules.

FAQs

Can I sponsor a partner visa more than twice? Generally no — the lifetime limit is two sponsorships, with a five-year gap required between them.

Does the sponsor need a minimum income? No formal income threshold exists, though sponsor character and financial conduct are reviewed.

Can a sponsor be changed after the temporary visa is granted? No — the same sponsor generally must remain in place through the two-year period to the permanent stage.

What disqualifies a sponsor? A significant criminal record (12+ months combined sentencing), certain family violence convictions, or exceeding sponsorship limits without an approved waiver.
