Most partner visa applicants focus entirely on their own eligibility and forget something critical: the sponsor must qualify too — separately, and just as strictly. Since the sponsorship approval reforms, Home Affairs now assesses the sponsor before the visa itself can be decided. If your sponsor doesn't meet the requirements, the entire application is refused — no matter how genuine the relationship is. Here's exactly what the Department checks in 2026.
To sponsor a Partner visa (subclasses 820/801 onshore or 309/100 offshore), your partner must be an Australian citizen, an Australian permanent resident, or an eligible New Zealand citizen, and at least 18 years old. Sponsorship must be formally approved by Home Affairs — it isn't automatic just because you're in a relationship. The applicant lodges the visa application first, then shares the Transaction Reference Number (TRN) with the sponsor, who lodges Form 40SP through ImmiAccount.

Under Regulation 1.20J of the Migration Regulations, a person can generally sponsor a maximum of two partners in their lifetime, and no more than one partner within any five-year period. If you've sponsored before, you'll typically need to wait five years before sponsoring again. Waivers exist for compelling circumstances, but Home Affairs grants them sparingly — this isn't a box you can talk your way around with a strong relationship alone.
Character assessment is non-negotiable. A "significant criminal record" generally means a sentence, or combined sentences, totalling 12 months or more. Family violence and sexual offence history trigger close, mandatory review under the family violence provisions strengthened in recent years. Sponsors with any relevant history should get advice before lodging — not after a refusal.

Sponsorship doesn't end at approval. Once the temporary Partner visa (820/309) is granted, the sponsor generally must remain the sponsor for the full two-year period leading to the permanent stage — sponsors cannot simply be swapped out. Sponsors are also expected to keep Home Affairs updated on any change in circumstances, address, or relationship status during processing.
