Remaining Options After a Missed Deadline
Even without merits review, limited pathways may still exist:
- Judicial review in the Federal Circuit and Family Court, but only if the original decision itself was affected by a jurisdictional error — this must generally be filed within 35 days of the original decision, not the missed ART deadline
- Ministerial Intervention under section 351 (or section 501J for protection visa character cases), a discretionary last resort with no guaranteed outcome
- A fresh visa application, where eligible, particularly if your circumstances have changed since the original decision
